Check the PMCs lease - ours has a clause requiring the tenants to report any water issues ASAP or they may be liable for resulting damages.But, the question then becomes, did the tenants know about the water issue?

In theory financially it makes sense if you can achieve higher return than the refi/2nd/heloc rate accounting for the reduced cash flow resulting from the higher leverage.
