It would only be a fraud issue if the tenant was sub-letting, collecting income, otherwise it is not fraud.Josh hit on the other issue, since there is now bad blood, you might consider moving and just take your time in finding another place where you might have more peace.

Shequann, just because the lease states they are respondsable doesn't mean you will ever be able to collect anything more than the original deposit and it will cost you a lot of time and money trying to get blood from a stone.

@Stanley Okazaki Not sure what your screening process is, but there were a few good suggestions you should use moving forward from @Dan Perrott and @Alberto De jesusYou should also have screening criteria somewhere in case you're accused of discriminatory practices.
