While the above-referenced items identify what is customarily required by Servicer to support a Loan Assumption request, Seller and Buyer acknowledge and agree that the terms, provisions and conditions of the documents governing the loan(s) to be assumed will ultimately control, including, without limitation, transfer fees and costs, release language, legal opinions and the documentation required to evidence the Loan Assumption.

An agreement should be drafted between buyer and seller that agrees to the amount being held in escrow and also should be subject to release by both parties.

You wire transfer that amount, the the  bank will then execute and record a Release in the county records.  

Legal counsel would be a good avenue to consider at this pointA couple of paths to explore:Did the Property Management Company have authority to re-lease the properties?
