You signed an agency agreement with your agent, or should have, your agent isn't concerned about you "cutting him out", the place is listed, he showed you the place, he was the procuring cause of the sale and the seller will be paying the listing broker who will in turn pay the selling broker who will pay the selling agent his commission, so, you aren't likely cutting anyone out.You are represented, you are his customer/client, he has a fiduciary responsibility to you as well as to his broker!

Small claims issue to small of money to involve any kind of lawyer other than a few sabre rattling letters. .. and your the one who is not performing.I have been on the other side of this back in my Timber days were I would secure a cutting contract only to have the land owner change their mind.We spent a lot of time and resources procuring our timber contracts.

If a sub-market were controlled by 2-3 large landlords and a tenant chose to not pay the rent and that data were consumed by the other landlords in that sub-market, that tenant is now facing a real uphill battle the next time he/she procures housing.
