i'd never get anything other than a 30 year loan. it not only gives me the flexibility to pay smaller payments if i want to, but extends my deductions for 30 years. in addition, if anyone tries to sue me for the house, "go ahead, take it. it has a 22 year loan left on it. start paying". lol

I will echo what @Ned Carey has said...you can't dig below the footer so you've got to have someone come in and extend the footers down far enough to get the desired headroom.

My accountant said that since this extended the life of the property, it could potentially have to be a depreciable asset - I on the other hand thought this was more of a repair since it was fixing a broken furnace.

Still wouldn't happen right away.Try to approach the situation diplomatically with him - you'll cooperate with showing the place, you'll leave it in perfect condition, but you cannot stay with that level of noise.Hopefully, he'll work with you and release you from your lease, and not keep your security deposit.
