Simply forgetting what you put where can be frustrating, but even more important, not keeping files in order, etc. can lead to violations of lead disclosure laws, fair housing laws, etc. and leave you defenseless in case of a lawsuit.

I am though for having some over site and mandatory disclosures.. just like we do now when folks buy a home you have a sellers disclosure.. or in CA when you make a loan as a broker you have a private lender disclosure were you have to identify if there is multi bene and if its a wrap.the risk to the general public from those that are not ready to take on this massive repsonsiblity IE keeping a sellers payments current and not trashing their credit dictates this in my mind.

And many states only require accurate disclosure for residential, not commercial properties (not sure which Alabama is here, but sounds like no disclosure for anything required).I have had some family members purchase a residential property in Colorado where the Seller's disclosure lied about some material facts (I think they stated the plumbing was in good working order, but they had covered up a known leak that caused a lot of damage).
