Although I certainly am not an attorney, it would appear on review of the above NJ laws that the tenants may be able to withold rent, and/or break their lease ***IF*** they have adequate documentation.The bottom line is, NO ONE can force a LL to take any action, and I dare say there is ALWAYS a choice to be made by the tenant...stay and deal, or move out.

If they want to force people to hold a license to broker a deal and receive compensation they can not let agents pay unlicensed people for helping or otherwise benefiting in some way.The question was raised by a licensed agent in the State of CT.

So, you shouldn't have to worry about someone coming in and mining or drilling, if you would still own a portion or all of the mineral rights, unless there is already a lease in force, which you can check with the title company, if it is recorded.
