Will the buyer accept your Assignment price or perhaps walk, claiming it is too high?

I'm preparing to take a tenant to small claims court for unpaid water bills in Baltimore City.

I inherited the tenant who was behind on her rent claiming repairs weren't done, hence, rent was withheld.  

So I satisfy the “2 out of 5 years” rule that allows the home sales profit from capital gains tax exclusion.I was wondering what documents do I need to submit when filing taxes for 2018.My tax person says that no documents need to be submitted to prove that, and me just claiming It is enough.Looking for second opinion.Thanks,Animesh

The wording is "Owner, on behalf of the owner's tenant, waives any and all claims against the HOA
