The replacement property must be owned for at least 24 months immediately after the exchange (the qualifying period) and in each of the two 12-month periods in the qualifying period: (1) the taxpayer must rent the replacement property to another person at a fair rental for 14 days or more; and (2) the taxpayer’s personal use of the replacement property must not exceed the greater of 14 days or 10% of the number of days during the 12-month period that the dwelling unit is rented at fair rental.

There is no "one off" clause with regard to Dodd-Frank compliance, and to make a loan on an owner occupied residential dwelling, secured by a lien on that property, the lender must be lawfully licensed to do so.

If it's not resolved, give them notice that your not renewing the lease at the end of the term, if you choose.You need to keep in mind, when you rent out a property, your handing over possession to the tenants for cash, and it becomes their dwelling, so all laws of the land come with it.

(e) A landlord and a tenant may agree for the tenant to repair or remedy, at the tenant's expense, any condition covered by Subchapter B if all of the following conditions are met:(1) at the beginning of the lease term the landlord owns only one rental dwelling;(2) at the beginning of the lease term the dwelling is free from any condition which would materially affect the physical health or safety of an ordinary tenant;(3) at the beginning of the lease term the landlord has no reason to believe that any condition described in Subdivision (2) of this subsection is likely to occur or recur during the tenant's lease term or during a renewal or extension; and(4)(A) the lease is in writing;(B) the agreement for repairs by the tenant is either underlined or printed in boldface in the lease or in a separate written addendum;(C) the agreement is specific and clear; and(D) the agreement is made knowingly, voluntarily, and for consideration.
