We are trying to avoid automatic acceptance of payments (either full or partial) from tenants we are trying to evict because some courts will stop the eviction process if any payment is accepted.

The only reason why I ask is you have to take them to court, you can show that the tenants acknowledge that it was in perfect condition when they moved in.

Also I would recommend that you do a proper inspection proper to tenants moving in and make sure you have it documented properly,  In the event you have to go to court to recover damages the judge will always ask you how know the condition of the property before the tenants moved in.
