Sounds like those properties have been performing well, if it ain't broke why fix it? 

If so, then in order to have it returned, you would need to exercise the contingencies in your contract prior to them expiring in order to receive your earnest money back.There is more to this.

We are also not performing any non-emergency repairs during this period.

While they could attempt to go after you for loses associated with non performance of the lease, in reality they will likely take your deposit and leave it at that.
