While I thought this to be an almost offensive offer, I later found out that I did not put enough stock into how bad they wanted to move on from their life as landlords and enjoy being retired in FL.The phone call I received from the listing broker later that day was bittersweet.

Repeating statements like, "I made a payment, but they claimed they never received it and charged me a late fee," would be a warning sign - for one, the company could be lying to stuff its pockets with late fees they get to keep for themselves; for two, if the unhappy tenant leaves, they get to charge you another lease-up fee; for three, this creates a civil/criminal liability situation...

I read the first part, and thought "yeah that makes sense" A landlord or other housing provider can be liable if its policy or practice regarding its use of criminal records is used to intentionally discriminate against individuals of a protected class.

If you're in a state that doesn't target landlord for the first offense (I think it's a one-bite rule or something) and if this home has acres between neighbors so you don't have to worry about noise complaints or much interaction between, I'd consider it if they provided their own liability insurance that clearly stated it covered the dogs and I could find my own insurance company that didn't have restricted breeds.

In terms of a rental agreements, I would recommend using a professional attorney in your area who is familiar with the NJ landlord/tenant laws to help you craft an air tight lease.For the tenant application:• You can get away with writing up the pre-screening questions yourself based on the preferences you have for a potential tenant• You can use an online screening service to receive credit, criminal, background, and eviction history and charge that fee to the applicant.At that point you can choose from the most qualified applicants.Best of luck @Kyle Brown

Also you wouldn’t be prosecuted for theft because you don’t have the proper criminal intent, nor would any agency bring criminal action against you so ignore that previous advice.
