One was appraised prior to construction at $540k and its been on market for 5 months at $450 and not moving.

I'm not saying you need to move to small town America but I wanted to give you a comparison.The only way I can see you staying in NYC and looking to invest in real estate is to find a way to make more money.

@Ed Hoffman, I believe for an entity like an LLC to do business in a state outside of where it was formed it needs to register in that state.
