If you care, your brother could send a letter to whatever 1031 Intermediary that was handling it, if you know, letting them know the 1031 never occurred...but no benefit to you guys and likely a waste of time.

Not saying you can figure other creative ways to finance the $500,000 property but I'd save this for later.Some sellers ask for preapproval letter as part of your offer so they know you have financing so this should be your first step that you can take action now.

The seller would be getting monthly cash flow from a vacant house/land, and then be cashed out at the end of the option period on the lease purchase...or with a balloon payment on a contract for deed.

We have lots of spots that are popular with Realtors for coffee or a beer.If they find that you've done a few deals, you might just get a cease and desist letter, if they see you're in the business and doing sizable transactions you might get some bracelets. :)
