From what I've heard from a lawyer is you can have a Delaware series LLC register as a foreign entity (out-of-state) and buy property in Maryland.

I don't see the FTB pursuing foreign LLC's owning foreign assets (outside of CA = foreign) just because one of the members is from CA.The bank accounts can be tricky, we had to develop relationships with bankers to refer clients to. 

Depending upon whether they are a bank or a trust company, custodians are heavily regulated by the IRS, DOL, and possibly the FDIC, State Banking Commissioner, and the Comptroller of the Currency.

However, a foreign investor from Korea (my uncle) learned what I was doing and wants to invest in me.

and where you live KY I suspect the thought of appreciation is a foreign concept.. where I grew up and at least in my last 40 years of doing real estate  break even cash flow properties now are worth far more than properties bought at the same time in areas that were " cash flow but no appreciation wanted or expected."   

The Texas LLC will have a Resident and Non-resident alien (foreign) member each owning 50/50 of the LLC with the resident being the manager of the LLC.
