If the house inspector has any clue what they are doing, they typically fire up the a/c and then the heat and actually make sure they cool/heat the unit....apparently they didn't do that?

Clues are: No one lives there, owner is out of state, there are lines from city for mowing the grass or code violations, owner is in jail or deceased etc.You may get owner to sign over property for their time instead of buying at FMV.

The topic stated "note hypothecation" which would be borrowing funds from a party and using the already generated notes as collateral, it would not include selling the note and using funds from sale to re-lend.With that said, I have no clue regarding the legal aspects of what you propose Lupe, however, I did reserach this a bit as i wanted to do the same with my 401k notes.

If not, he needs to comply with the SAFE Act, and your transaction, will not be owner occupied and may under state law be considered a seller financing transaction which means you will need to comply with the SAFE Act as well.....And, you need to check under state laws as to how lease-options might be treated with the new Consumer Federal Protection Agency (CFPA).If anyone tells you that this type of arrangement is OK to do without being concerned with those laws, they don't have a clue and it sounds like you're being coached by someone that has an interest in the deal.

I have no clue what's coming next but I don't see significant drops in rent in most areas so as long as I have a solid cashflow I'm cool with riding out whatever may come.
