I have given them the option to give up the unit within 7 days in good condition in exchange, I will void the lease and take no further legal action providing no major damage is found.   

My husband is telling me that I should sell this property on "as is" condition but I think that is not a good idea.

I would make it a condition in my offer that the property must be vacant before closing.
