I believe this would be a "tenancy in common" situation but I am looking into ways to split the property as to have a clean deed/ title.Should I be looking into finding a title search company and a real estate lawyer to resolve this issue?

You will need them and they will make your life easier.

The bigger units are so much easier to manage cash flow better and have economies of scale built in not like the huge units but still better than the smaller apartments. 

Yeah, I think you're being Way to concerned about this....the property is either delivered vacant and broom clean, or you don't close.

But they also, in my experience, have better price appreciation and are easier to sell.Small multis are less work to acquire more units and cashflow and thus allow you to scale faster.So, it really depends on what you're trying to accomplish.
