If the OP records his agreement, doesn't the original seller still need to deed the property to the OP, so the OP can complete a sale to a new buyer?

Sounds like the OP was looking at an installment sale / contract for deed / land contract type of sale, based on stating the owner collects payment but never transfers a deed.

I never use prepayment penalties, but there is not a lot of interest to be made on these buyers.Pretty sure the OP would be challenged to get an option to buy from the seller at this point.
