Also, if the agent was on the ball he would have known precisely how far along the foreclosure was and certainly when the sale date was going to occur since I'm sure there's at least a 30 day notice of the sale, particularly knowing the loan was in default already.

At the very least, even if no prohibited transactions occur, your flexibility will be limited when partnering with your retirement funds as care must be taken not to violate any of the rules (self-dealing, transfer of ownership between partners, enabling, etc.)

I expect that they would normally need a very good reason to appraise it differently than the actual purchase price that just occurred, if the house is in basically the same condition.That's ONE reason why Lenders have a seasoning period requirement, before granting refinancing.
