I believe the approach you described of using the market cap rate against your increased NOI to determine the increased value of your property is more appropriate for commercial buildings (5 units and up).

This could prevent a good applicant from looking at your property if the management company is not viewed positive. 

Lawyers love to represent clients that ultimately require them to do nothing but send you a bill.I know that most of the American population either lives in fear of being sued or view law suites like buying lottery tickets but as a landlord you need to get a grasp on reality and take it slow.

The deal you are describing isn't great, but it isn't the worst I've seen.
