Had a question regarding a partial 1031 exchange and how 1250 depreciation recapture is calculated, facts are below.12/1985 - 2 flat property purchased for $60k, residential rental real estate (fully depreciated today, 0 tax basis)6/2016 - enters into 1031 exchange, sells above property for $150k, receives property (also residential real estate), FMV of $100k, $50k in cash also received.

My thinking is regarding 1031 exchanging properties until I build up a net capital gain of 500k then live in it 2 years to sell it tax free.

We have had good and bad posted here about the DF Act and SAFE Act, I did listen to any attorney seminar (D-F expert, but not really) that broke it down quite well for investors, except that he went on to employ trusts, business entities, family members and other types of convoluted exchanges to justify staying within the exemptions.
