I was under The impression that depreciation recapture carried over from an exchanged property to the new property only came in effect when the new property was sold without carrying out another exchange vs not being able to depreciate as much during ownership.

I wasn't under the impression that I had to take a tenant at their word on this but her attorney seems super confident and is suing for double the security plus attorney fees, which has a burden of proof on them to prove "willfulness" in retaining the deposit.

Pictures can give a completely false impression, and if it's not the property condition, it could be the neighborhood condition.I'm a turnkey girl myself, just because it's a million times easier to buy out-of-state.
