If you could create documents and the tenants weren't required to sign them to make them legally binding, then that essentially opens the door for ill-intentioned landlords to incorporate new rules and procedures without the tenant knowing, and then take legal action against them when they (the tenants) didn't know.

I'm sure you wouldn't intentionally put your parents in that situation, so either way I would reconsider the proposed terms of this loan.Once you ultimately do come up with acceptable terms, you really should consider offering your parents the same protections that you would any other lender.

We don’t think the titling company may do so intentionally, but people come and go, and someone may find the check in a wrong file folder in 5 years and decide to cash it to be thorough.Thank you!
