That lawsuit is a claim for fraud, and that’s what fraud typically is...a misunderstanding and someone being “injured” and wanting to hold the other responsible for it.

@Chad UrbshottSometimes it doesn’t take a savvy attorney but one who is similar to an ambulance chaser and the moment your servicer contacts or attempts to collect they have their attorney file FDCPA violations against you, then sue you in federal court and file a 60Page claim against everyone that ever owned the loan.

You could do a simple Quit Claim deed to move the note to a LLC.

If the property is not your primary residence then do not claim it as your primary residence.

If anyone claims to know that, your next question should be "OK, so you claim to 'know' that... why are you talking to me?

I know you will have to work your way through 2-3 levels of customer service before you get to a person with some authority but I would start there.   

Some lending attorneys claim they can address licensing in every state.

Consider small claims court if the lease says it is due and it wasn't collected.
