If you did back out you would be in breach and could be liable for any damages they incur which could be finding a hotel and storage until they can find a place to rent.In your initial example they were in breach of the contract however the judge ruled that you had no real damages. 

Think about it, no one goes to stay in a rundown hotel with no pool.
