I am not sure of the exact laws with a suit to partition and judicial sale, but maybe you can recoup your expenses (the other 99% of the tax bill you paid) through that suit when the property is sold.

Just be aware there are people with two year accounting degrees and even people with no formal accounting education out there doing taxes.

We did go through all the formalities of having a lease etc.  

Any Government assistance typically provides at least an annual formal letter stating what the benefit is and dollar amount.
