My advice would be to spend an hour with a lawyer who does business entity work.

If nothing happens and the homeowner pursues legal action, I would assume a lawyer would come after both parties.

The same is true for lawyers, some kid out of law school doesn't command the same fee structure of a lawyer with 25 years of experience and a track record of hundreds of cases won in technical aspects of law. 

I have used ezLandlord in the past and believe it will let you go through all the parts and give you some ideas without paying.However, I would suggest you find a lawyer to build it for you.I now use property management and think that is another plus when starting out to learn a much as you can from them.

I've seen lawyer fees of over $3000 to start an LLC but also rock bottom online assistance to do the same thing.
