From your building/comps numbers...looks like you’ll spend about $225k (plus a lot of time and effort) for a Gross sales price of $250k, netting little more than $235k....a wash, do you’re still out the $90k purchase...that’s like just totally walking away now, a $90k loss.

Perhaps an attorney can clarify or revise my memory.Another thing I remember my attorney saying is if she does make a deposit into the account, you can "partition" it in the account (i.e. not spend it) and send her a written notice reiterating as per your lease agreement, you cannot accept partial payments, and her most recent deposit is being held in the account in which it was deposited, pending the outcome of the litigation" or something similar.I, too, use a common bank account for tenants of the same building, so that's what he told me to do when I had a similar situation a few years ago.Of course, YMMV and this may not wash in your jurisdiction.

I want to make sure that my new note of $480 des NOT become a negative via y DTI , as I hope to purchase another property in the future. So if I can Immediately claim this Rental Income as Income , then it will technically be a wash( No Loss and No gain ) , and this will in theory keep my DTI in the good .How do I go about claiming this Rental Income as ACTUAL Income that is coming in to me on a month to month basis , so by claiming it..... it can offset my House Payment ?
