If your tree is in good health, you have no knowledge that it was unhealthy, and it damages an adjacent property; then it is not your issue.

There are several different ways to do this but you need to verify the lien is paid for in advance of the scheduled foreclosure sale. 

I use an economic unit addendum, which basically states that they are jointly and severely liable for all terms of the lease.
