But when they didn't make up the missing 2 months' rent, I sent them a Certified letter letting them know they were in default, and they needed to pay it by 10/15.

Some other states may just do tax sales/liens administratively, where you're just dealing with a local county office and filling out some forms/contracts and won't necessarily have to worry about the possibility of needing an attorney for court appearances.3.

Since this is being done with the ok from the lender - it seems like we need some version of #2 - where they give the blessing with a “change in terms” or assumption - and that we negotiate what changes are acceptable. 

I agree with number 3 the most, as most of us who have been in the game for over 30 years will all say we shouldn't have sold so much.
