I am not sure there is a document that can protect both of you... and in today's environment just simple claim... real or imagined of abuse or hostilities and there isn't an agreement around that will survive those claims.I currently have a client who just went through the same thing.

I also think its possible we fall into a deflationary environment and rates fall, which makes this whole argument moot.

You are still leveraged too highly on your personal home in my opinion (88%) and should pay down even more - I'm not sure you could ever refinance if necessary in today's environment.
