The 1031 exchange will indefinitely defer all tax on profit and all depreciation recapture.

It is not your responsibility to house this person's items indefinitely in your rental. 

There is no point in looking at a home that can not reasonably obtain a permit.

In other words - if you do not cashout refi either the new property after rehab or the existing rental, then where will you obtain $100k cash to pay off the heloc? 

Then any rental income you could obtain from that property could be used as an income source for loan pre-qualification.
