Client owns a portion of an existing shopping center, and some of his portion is undeveloped (the “surplus property”).I attempted to buy the surplus property for my own development purposes, but I could not come to terms with the Seller.Seller (not a real estate guy) decided to attempt to self-develop the surplus.This is where my “Seller” became my “Client” as he hired me to handle the development for him.I’d put in a lot of time, but now the only way to monetize the opportunity was to pull out some consulting fees.He hired me (yes, we had a contract) to determine what to build, how much rent could be expected, to coordinate with the other tenants, navigate through the leases, the REA, etc.It now appears he is not going to pay me the last installment of my fee.Can I file a lien?

Im sure it was well worth the completion extension toward the back end of the rehab.I have a couple of questions about your rehab and finance decisions:As far as the finance portion, Im trying to make sure that I understand why you chose to use hard money for the purchase and rehab.

Appeal ensued, and case was remanded to award attorney fees for the portion of the fees which were earned on the prevailing claim (bad conditions).Landlord never filed a brief to the appeal, but CAR and CAA did so supporting the landlord, as well as a number of groups supporting the tenant (definitely a good list to keep for donation references as well as groups to put on a donation blacklist).

Cost of prior event - ~$2800 to pull up two floors, replace a section of the subfloor; replace a portion of the sound / fire break insulation between the units; remove mould and mildew from the remainder of the subfloor and relay finish flooring in two rooms.They have comeback twice since then to ask more questions about our system.Ask me the question again in the spring and I hope to have more positive news.
