The police may tell the tenant whom is complaining to contact either animal control or the landlord (when I called the police about the dog next door barking in the middle of the night they showed up but also forwarded everything to animal control - at least in my city animal control has the power to fine the offender and the police don't).

If you are going to reuse the rail, I would burn off all the old paint and re-sand it real good before you put it back on, then a new oil based primer and 2 finish coats.
