You could also have a contract inside the trust agreement which specifically spells out a trustee's fee that must be paid and is irrevocable so that once the beneficiary is named, the trustee (you) will be guaranteed payment or you could sue the beneficiary/trust for damages.

In fact, I've had cases where I've offered 10% more than list price and the bank still didn't agree to the sale.In general, you can ask the listing agent what the BPO price was, and whether s/he thinks there's a reasonable chance a specific offer will get accepted, though there's no guarantee they will have any idea (though they'll probably be honest, since their goal is usually just to get a sale done for their buyer).
