The second got wiped BUT filed a lawsuit claiming they did not know the power of attorney signed the subordination agreement and since the loan was dated after theirs they feel they are in first (even though in this jurisdiction a subordination agreement is not needed and the refinance of the first is automatically subordinated).

Joint tenancy means equal ownership, and if one owner passes away, their share automatically goes to the surviving owner(s), giving sole ownership.
