Pro: No depreciation recapture Con: If you have income it reduces your asset amount for calculating QBI I would also be fairly surprised if land was only $10k on a $100k purchase- how was that calculated There's no depreciation recapture because there's no depreciation, but according to the regs there is ordinary income tax due on the entire sale amount that corresponds to the carpet....given that the whole purpose of the safe harbor is to reduce record keeping, the reg seems illogical as how would you know what corresponds to the carpet without having it on the asset schedule, but it's there in black and white in Reg. 1.263(a)-1(f)(3)(iii)Michael Plaks I believe highlights this in his example where he allocates a $500 residual to your $2500 carpet and said $500 is 'recaptured' at ordinary rates, although technically not depreciation recapture since the item was expensed and not depreciated.See also:https://www.law.cornell.edu/cf...https://www.claconnect.com/Wor...https://www.ruraltax.org/files...

But depending on your credit and situation they can be a good bridge loan for a few years until you are able to refinance with a regular bank loan that has lower payments.So I would recommend asking around and networking with other hard money and private lenders; I strongly suspect you will find one that meets your needs.If you don’t, let me know and I may be able to connect you with a few, or you could attend a local real estate meet up such as RIREIG in Rhode Island or Black Diamond REI in southern Massachusetts.
