You both have equal rights to the title, and your land contract is probably null and void, meaning you can't get the property back easily if they default, and you are on the hook for the whole mortgage.If you have only sold on contract, then you are the owner, and the buyers have an ownership interest, and you are the "lender".

So my household income (my spouse and mine) is good enough (above $75K) to get money from hard money lender but my sole income is less than $30K/year which derives my question whether I can get financing easily considering my household income and if I have enough cash to put up front for a deal or does my spouse's name have to be on the deal as well?

Your best source of how it is done in that area would be the assessors office though, they should be able to guide you easily on how they do it.
