Just like @Brad Hammond said, I would tell them the property will be delivered "as-is" and if that is not acceptable, you understand and will happily return their funds so they can pursue another property that better meets their needs.

You are looking for contracts actions or "failure to deliver premises" - but in the end it will depend on the language of your agreement.In reality, the money you spend and the time it will take to get a settlement/judgment might exceed the 6-week delay, and it might be easier to just get an alternative place.
