I'm still watching it, him, and his other property for some solid evidence.If I don't see anything concrete before the 60 day move in requirement I am going to hire a private investigator to gather evidence.

The easiest way is simply to buy at the price, the agreement is evidence of the debt assumed by that seller and there is no need for another note to be made to match the 2nd, the property is sold subject only to the first motgage and the seller must provide good title.

I'm in mortgage banking and as I understand the guidelines you need two years of history managing rentals which the evidence is typcially two years on claiming rental income on your tax returns.

In RE, we don't have a title as we do with personal property, like a title to a car, the evidence of ownership is by deeding the property.

That technically and legally puts any unknown defendants on notice that they must enter an appearance in the lawsuit and present evidence as to their claims to the property.  

But, because there was so much stolen merchandise in my husbands house, the police wouldn't let him proceed with the eviction because all their evidence was in the house.
