Please help me know if I've got this straight: enter into a lease agreement (agreement #1) and also an option agreement (#2) at the start of the term and only enter into a purchase & sale agreement (#3) once the term is up OR when tenant/buyer decides to exercise their right to buy.

Say if I entered into escrow on a property, went through entitlements, and put in money to develop the project, and upon successful achievement of entitlements sold the property for a higher price than what I was in contract for, would the profits fall into the category of capital gains or ordinary income (like in a wholesaling transaction).Will reach out to an accountant in a couple weeks but curious to what people generally do in this circumstance.Thanks in advance.

We have a very open line of communication with our tenants with regards to requesting maintenance (they can enter a request online via our PM software), and I'd say it's exceedingly rare for us to go more than three months without entering a unit for a maintenance task requested by the tenant.
