In judicial foreclosure states, you have to file a lawsuit to foreclose so I've gotten used to the process of borrowers putting up defenses, which is very similar to these 4 lawsuits where the borrower is the plaintiff.Our servicer has been named as a defendant in the 4 cases, 2 of which were by the same borrower.At the beginning, you need to be clear on who is defending whom.

If you do go that route, you sue for "specific performance", meaning that the court can order the defendant to fulfill the terms of the contract.The question in this case goes to whether the contract was fully executed.

I understand you can use any certified/licensed appraiser....i didn't know if there were companies that specialized in distributions from self directed ira's that understood the need for a conservative appraisal that could be defended to the irs.Thanks again

Otherwise, you have to defend the lawsuit, in which case you might win the case but effectively lose all your assets because of legal fees.So, you see whatever youare doing as a BRRR investor doesn't make sense?

Ask any attorney who will give you an honest answer, and they'll say that a litigation lawyer is more likely to file a nuisance suit with little to no merit against a defendant with significant assets, than to file a legitimate suit with demonstrable merit against a defendant with little to no assets.Bottom line, in our super-litigious society, I think it's worth spending a few additional bucks to have plenty of liability coverage.
