A lot of the "90%" funding people will ask for a non refundable EMD and then prevent the deal from closing or hold up the title work.  

If the lessee overstays, my guess is that an eviction process could begin.The only option to prevent a lessee from losing the leasehold property is to buy the leased-fee interest.
