One asked me to sign an exclusive buyer agency agreement, and the other one never mentioned signing anything and ultimately brought me an off market duplex which I purchased.

They won't say exclusively "student housing" but it shouldn't be too hard to figure out who they are going for based on the types of properties, distance to campus and price. 

If you're correct and the deed wasn't recorded in Nassau County then I think there would be a claim under the policy since it insures his interest to the exclusion of all others as of the date of policy.
