Since a house sale is not subject to sales tax, and the end user isn't paying it, then it must be paid on all the materials you buy during the rehab process.

In my area there are MLS overlaps between numerous MLS's [which has been the subject of a lawsuit] as such you can occasionally find a prop. listed  on the "wrong" MLS which are listed on public sites such as Zillow etc. but not on the common MLS for that area.

Seller MIGHT be subject to a deficiency if the state they are in allows it but at least they are out of it and at the end of the day, they don't care if its underwater.Does the bank want a short sale over a foreclosure sale?
