The real issue is any state can look at their RE code and conclude that selling or marketing a property that you don't own and expect to make a financial gain is selling RE without a license whether you do a phony listing agreement and assignment deal or whatever. it goes to intent.and you can be correct but if a state wants to make the claim your going to spend thousands trying to defend yourself and your going to lose unless you have deep pockets and want to take a case to the appelatte court level.our average wholesalers that have no real money are not going to get very far with this.. ones that are big players and make millions well they probably have figure it out or could defend themselves.
