Where I'm confused is whether me structuring a deal to acquire a property from a seller facing foreclosure is me servicing myself and setting up a deal for myself or me providing help to seller simply because they receive benefits from participating in the deal.

I have the ability to fund this now at a basic level but with full participation we can attend events and conferences like Pitbull and AAPL as a sponsor which gives us credibility and access to hedge fund level players and fund managers not just Accredited Investors.We will have a servicing company to handle the loans after closing.

So, in your example, if you have 5 people who will invest and actively participate in the deal, it is a JV not a syndication.But as others have said, I'd speak with a securities attorney.

Some realize wholesaling is much more scalable than buy and hold or flipping and take it to an institutional level; Networth, New Western, etc. 2nd question: this is irrelevant, never trust a wholesaler for anything other than the address.

Also I was told that this type of loan (depending on how stringent the lending institution is) can only be held in your name.I went ahead and applied anyway and I have been accepted for one through Loan Depot so I'm still looking into alternative sources of financing because the more options the better.
