I'm pretty sure that more regulations would be agreed to instead of outlawing them, that it would be better regulated as having legal ownership, otherwise you'd have mass non-compliance.

I doubt you need an LLC.However, make sure you are in compliance with real estate agency laws or you could inadvertently be practicing real estate without a license and get yourself into trouble.
