You need to look at IRS Code to determine what "being in the business" means and all regulatory agencies use that determination to identify the difference from investing and conducting business.

The first is foreclosing on the borrower, the court date is set and the unpaid balance of the loan is $170K, I cannot identify if attorney fees are included in this amount.

Might do well to advertise that you don't expect funds to be wired after taking a generic application with no company identifiers, and promise to give an address after receiving payment! 

Mice cannot be a problem if they can't get in, and unless the tenants are leaving something open to invite them in, there is/must be some entry point in your house - and once mice identify an entry point, it is open season until you seal that point.
